The South Carolina Supreme Court this week struck down the state’s ban on abortions during the time when a baby’s heartbeat can be detected, which happens around the sixth week of pregnancy. According to the court, the law allegedly violated women’s right to privacy.
“We believe that the decision to terminate a pregnancy is based on the most personal and private considerations imaginable, and implies a woman’s right to pregnancy.” – this is how the judge, Kaye Hearn, commented on the verdict.
“While this right is not absolute and must be balanced against the state’s interest in protecting unborn life, a law that severely restricts – and in many cases completely excludes – abortion is an unjustified restriction on a woman’s right to privacy and is therefore unconstitutional.” – she added.
Recall that the South Carolina General Assembly passed a law banning abortions in 2021, but it was blocked by federal courts.
